ZeroJet Electric Jet Propulsion System Warranty

DEFINITIONS

This ZeroJet Limited Warranty (“WARRANTY”) is a voluntary manufacturer’s warranty by ZeroJet Limited, a New Zealand Limited Company, company number 5743831 (“MANUFACTURER”).

ZEROJET SYSTEM

The ZeroJet System refers to the electric jet propulsion system manufactured and distributed by ZeroJet Limited (“ZeroJet System”) and installed in the boat by a boat builder or a dealer (“Dealer”) authorized by the Manufacturer.

The ZeroJet System consists of the Propulsion System and the Battery System, as defined below:

Propulsion System

  • Jet Pod Assembly (containing jet pump, motor, motor controller, cooling system and reverse system)

  • Throttle

  • Display

  • Hub

  • Wiring Harness & Cabling

  • Standard AC charger and charging cable

  • Battery box(es)

     (together, the “Propulsion System”)

Battery system

  • 48V LiFePO4 batteries

  • Battery Communication Interface (BCI)

    (together, the “Battery System”)

CUSTOMER

“Customer” refers to the owner of the boat containing the ZeroJet System registered with the Manufacturer and to any subsequent owner (refer to the section titled Subsequent Owner).

DELIVERY

“Delivery” refers to the delivery date to the end-customer of the boat containing the ZeroJet System to the Customer. This date will act as the start of the Warranty period.

WARRANTY PERIOD OVERVIEW

Subject to the exclusions provided within this document.

* Extended to 36 Months if yearly serviced by a MANUFACTURER Authorized Service Centre and the ZEROJET SYSTEM has been registered with the MANUFACTURER within 60 days of CUSTOMER purchase.

SUBSEQUENT OWNER

The Warranty set forth in this document may be transferred to any subsequent owner if all of the following conditions are met:

  1. The Warranty period has not expired.

  2. The Customer has complied with all terms and conditions of this Warranty.

  3. The ZeroJet System has not been removed from the boat.

  4. The subsequent owner has transferred the ownership through the Manufacturer’s Customer Portal or Customer Support team.

WARRANTY CLAIM HANDLING

  1. To claim under this Warranty, the Customer must file a claim (“Claim”) with either the Manufacturer (using the Manufacturer Customer portal or Customer Support team) or the Dealer, providing all required information about the ZeroJet System and a description of the failure and failure conditions, within ten (10) days of the problem first appearing. If the Claim is made to the Dealer, then the Dealer will handle the Claim with the Manufacturer.

  2. If possible, the Manufacturer will try to resolve the issue remotely.  The Customer or Dealer will follow the instructions as provided by the Manufacturer.

  3. If the issue cannot be resolved remotely, then the Manufacturer will either send a replacement part, or a full replacement product to the Customer or Dealer.  Replacement parts or products could either be new or reconditioned.  The Manufacturer cannot guarantee that replacement parts will match the colour scheme of the original part. 

  4. The Manufacturer might decide in consultation with the Customer or Dealer that an on-site intervention by a Manufacturer technician is required to resolve the reported issue.  This decision will be made at sole discretion of the Manufacturer.  If the Manufacturer determines that an on-site intervention is required, then the Customer or Dealer will make sure that the ZeroJet System is available for such service intervention at the agreed time and location.  The Customer must sign the “Acceptance of Special Conditions of Sale - Ship Repair Work” document provided by the Manufacturer before the actual intervention can take place.

  5. The Manufacturer will dispatch replacement parts to the location where the ZeroJet System was initially purchased.  Shipments to any other location will be treated on a case-by-case basis.  All local duties and taxes are at the expense of the Customer or Dealer.

  6. All parts replaced shall become the property of the Manufacturer.  The Customer or Dealer shall return the replaced part to the Manufacturer service location.

  7. The replacement part(s) shall have the same Warranty expiry based upon Delivery of the original ZeroJet System.

EXCLUSIONS

CONDITIONS

This Warranty does not apply unless:

  1. The ZeroJet System has been installed by a boat builder or a dealer authorized by the Manufacturer.

  2. The ZeroJet System is installed in the same boat as provided in the Warranty registration.

  3. The ZeroJet System has been properly operated, maintained and stored as specified in the Manufacturer’s owner’s manual (“Manual”)

VOIDANCE OF WARRANTY

This Warranty will be void if one of the following conditions applies:

  1. Incorrect charging or overcharging of the batteries, or incorrect run down of the batteries.  Battery maintenance instructions are provided in the Manual.

  2. Use of battery charging equipment which is not authorized by the Manufacturer.

  3. The battery system has been used to power other equipment.

  4. Damage caused due to the intake of rocks or debris in the ZeroJet System.

  5. Improperly installed accessories or use of parts or accessories that are not authorized by the Manufacturer.

  6. Damage because of accident(s), collision(s), contact with foreign materials, impact, submersion, or use of the ZeroJet System after discovery of a defect or neglect of a warning message.

  7. The ZeroJet System has not been maintained according to the required maintenance schedule as provided in the Manual.

  8. The ZeroJet System has been serviced other than in accordance with the servicing instructions provided in the Manual.

  9. The ZeroJet System has been modified in any way from the standard specifications as shown in the Manual.

  10. The ZeroJet System has been removed from the boat in which it was installed initially.

  11. The serial number label(s) of any of the components of the ZeroJet System have been removed or altered.

  12. Damage from theft, fire, vandalism, explosion or any other cause beyond the Manufacturer’s reasonable control.

  13. The ZeroJet System has been used in a manner contrary to applicable laws or not within the Manufacturer’s reasonable contemplation.

  14. The warranty claim has not been notified to the Manufacturer (or authorised Dealer) within ten (10) days of the problem first appearing.

  15. For Claims relating to the Battery System, any other matter that voids the battery supplier’s warranty (details of battery supplier’s warranty available on request).

ITEMS NOT COVERED BY WARRANTY

  1. Growth of marine organisms on any part of the ZeroJet System.

  2. Loss of battery pack capacity within the battery specifications (refer to the Manual).

  3. Normal wear and tear, corrosion and discoloration of any material of the ZeroJet System.

  4. Any service materials as mentioned in the Manual.

  5. For Claims relating to the Battery System, any other matter not covered under the battery supplier’s warranty (details of battery supplier’s warranty available on request).

SOLE REMEDY

To the maximum extent permitted by law:

  1. The Manufacturer disclaims all representations and warranties, express or implied, including any warranty of performance and/or merchantability or fitness for a particular purpose, and any other obligation or liability on behalf of the Manufacturer;

  2. This Warranty constitutes the Customer’s sole remedy and the full liability of the Manufacturer; and

  3. In no event will the Manufacturer be liable for any loss of profit, revenue, savings, business, data, goodwill, or any consequential, indirect, incidental or special loss, damage or injury of any kind suffered or incurred by any person, howsoever caused, whether by negligence or otherwise resulting directly or indirectly from the supply or use of the ZeroJet System.

SOME REGIONS OR JURISDICTIONS DO NOT ALLOW FOR THE DISCLAIMERS, LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR OTHER EXCLUSIONS IDENTIFIED IN THIS DOCUMENT. Nothing in this Warranty has the effect of contracting out of any liability that cannot be excluded by applicable law. To the extent MANUFACTURER’s liability cannot be excluded but can be limited, MANUFACTURER’s liability will be limited to the purchase price paid by CUSTOMER for the ZEROJET SYSTEM.

THIS WARRANTY GIVES YOU SPECIFIC RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH MAY VARY FROM JURISDICTION TO JURISDICTION.

This warranty is governed by the laws of New Zealand. In the event of any translation, the English version of the warranty will prevail. In the event of any dispute, the parties irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.
